В Жаркенте суд рассматривает дело о выдворении из Казахстана этнической казашки Сайрагуль Сауытбай, обвиняемой в "незаконном пересечении границы". Приговор суда ожидается сегодня.

Сайрагуль Сауытбай на свободе
Суд постановил установить за осуждённой пробационный контроль сроком на шесть месяцев и засчитать время нахождения под стражей - с 23 мая 2018 года по 1 августа 2018 года. Председательствующая судья Динара Куйкабаева сказала также, что суд не применил предусмотренное данной статьей дополнительное наказание в виде выдворения за пределы республики.

Сот Сайрагүл Сауытбайды Қазақстанда қалдырды
Алматы облысы Жаркент кентіндегі Панфилов аудандық сотында "шекараны заңсыз бұзды" деп айыпталған Қытай азаматы Сайрагүл Сауытбайдың ісі бойынша шешім шықты.
Тамыздың 1-күні түстен кейін Панфилов аудандық сотының судьясы Динара Құйқабаева Қытай қазағы Сайрагүл Сауытбайды Қазақстанда қалдыру туралы шешім шығарды.
"Қазақстан Қылмыстық кодексінің 392-бабы 1-тармағы бойынша Сайрагүл Сауытбайды кінәлі деп тауып, 6 айға бас бостандығынан айыру туралы шартты жаза тағайындалсын. 6 ай мерзім пробациялық бақылау мерзімі тағайындалсын. Сот залынан босатылсын" деді судья шешімді оқығанда.
Судья "Сауытбайдың қылмысын онша ауыр емес" деп бағалады. Ол шешім шығарғанда БҰҰ балалар құқығы конвенциясы негізге алып, Сауытбайды екі баласынан, отбасынан ажыратпау үшін осындай шешім шығарғанын айтты.
"Этникалық қазақ ретінде, Қазақстан азаматтығын алуға құқығы бар азамат ретінде оны Қазақстаннан шығарып жіберу жазасы тағайындалмады" деді ол.

ZHARKENT, Kazakhstan -- A court in Kazakhstan has convicted an ethnic-Kazakh Chinese citizen Sairagul Sauytbay of illegal border crossing, but has ordered her release and said she will not be deported to China.
The August 1 ruling indicates that Sauytbay will be reuinted with her family in Kazakhstan and not returned to China, where she has said she feared she would face "the most extreme" punishment.
Sautbauy fled China in April and has testified at her trial in Kazakhstan that thousands of ethnic Kazakhs and other Muslims are undergoing "political indoctrination" at a network of "reeducation camps" in western China.
At the trial in Zharkent, outside Almaty and close to the Chinese border, Judge Dinara Quiqabaeva (eds: a woman) sentenced Sauytbay to six months of parole, ruling that the sentence is suspended due to the "exceptional circumstances of the case."
"Taking into account the fact that the defendant had to commit the crime because it was the only way for her to reunite with her family, the crime cannot be considered serious," the judge said.
Sauytbay's husband and two children have been living in Kazakhstan for several years and obtained Kazakh citizenship last year.
Sauytbay, 41, was not allowed to leave China as she had a status of a state official there.
Before crossing into Kazakhstan on April 5, Sauytbay had been the head administrator of a kindergarten -- a position that, together with her membership in the Communist Party, technically made her a Chinese state official.
She was arrested in May at the request of the Chinese authorities, and Chinse diplomats have attended her trial.
In trial testimony, she said Chinese authorities had forced her to train "political ideology" instructors for reeducation camps in western China's Xinjiang Uyghur Autonomous Region.
That, she said, gave her access to secret documents about what she called a Chinese state program to "reeducate" Muslims from indigenous minority communities across western China -- mainly Uyghurs, ethnic Kazakhs, ethnic Kyrgyz, and Hui.
She says she also witnessed the inner workings of the program while employed at a camp for ethnic Kazakhs in the region's Mongol-Kuro District.
